Ohio’s cannabis laws and regulations have changed drastically in the past year. In fact, state legislatures are still trying to work out some of the details of the recently passed Issue 2. Recreational Marijuana Is Legal
On November 7, 2023, Ohio voters passed Issue 2, which allowed for the legalization of recreational marijuana. As a result, Ohio became the 24th state to legalize the drug. With that, any adult 21 and older can buy, possess, and grow marijuana.
While the law was effective on December 7, there are no legal ways to purchase recreational marijuana in the state. As of now, the only way that someone can use recreational marijuana is by growing their plants. Adults can produce up to six plants for individual use. However, if multiple adults are in the home, that limit increases to 12 plants.
Regarding the possession of recreational marijuana, adults can have 2.5 ounces of marijuana and 15 grams of extracts.
Marijuana Sales and Levied Taxes
Once there are legal places to purchase marijuana products, they will be taxed at the state’s regular rate, with an additional 10% tax. All the revenue from these sales will go to:
- Municipalities with dispensaries
- Social equity and jobs programs
- Substance abuse funds
- State administration costs
When will state residents be able to purchase legal recreational marijuana? State licenses have yet to be issued. The early date for distribution could be later in 2024.
Other Regulations
Despite the legalization of recreational marijuana, you cannot use, cultivate, dispense, or process cannabis on federal, state, or locally-owned land. These areas can include:
- Government building
- Public parks
- Other public areas
Additionally, bars, workplaces, and restaurants do not have to accommodate the use of recreational marijuana, and they have the right to prohibit the use of cannabis on their property.
Driving Under the Influence
In Ohio, driving under the influence of marijuana is illegal, as it is in all states. This law applies to operating a motor vehicle, boat, or aircraft while under the influence of marijuana.
According to the Ohio Revised Code, no person shall operate any vehicle within the state while under the influence of alcohol, drugs, or a combination of both.
Medical Marijuana Laws
In Ohio, recreational use and medical use of marijuana are both legal under specific circumstances. Medical marijuana is available to authorized patients who have a medical marijuana card and are under the care of an Ohio-licensed physician certified by the State Medical Board of Ohio. These patients can purchase and possess limited quantities of cannabis daily.
